General Terms and Conditions

"D&K Travel" Ltd is a limited liability company registered in the Republic of Bulgaria under number BG201970323, legal address: Aheloy, Bulgaria, Pliska str. 4, 2113, trade mark Bulgaria Holiday Transfers. "D&K Travel" Ltd (Bulgaria Holiday Transfers) specializes in the management and execution of passenger transportation (transfer services) from airports / railway stations / ports / hotels to tourist areas / cities (railways / ports / airports / hotels) in accordance with the bookings (orders) made through our own website www.bulgariaholidaytransfers.com by our clients (hereinafter the words "we", "us", "our" etc. mean Bulgaria Holiday Transfers. Customer - a person using our website, booking (order) form and transfer services. Transfer service is the transportation of passengers (clients) from the point of departure to the destination according to the client's order. Bulgaria Holiday Transfers provides transfer services directly and reserves the right to outsource the provision of these services to any other licensed transport companies operating in Bulgaria. Please note that when traveling with any partner of Bulgaria Holiday Transfers, the conditions for the carriage of passengers and luggage, as well as the rules of conduct of clients during the transfer remain the same. These Terms and Conditions, as well as the information provided on our website and the voucher (booking confirmation) constitute an agreement between Bulgaria Holiday Transfers and its client and apply to all bookings (orders) made on our website www.bulgariaholidaytransfers.com

Making an Order

By booking a transfer service with Bulgaria Holiday Transfers, the customer agrees to and is legally bound by these terms and conditions. Bulgaria Holiday Transfers reserves the right to amend these terms and conditions from time to time and upload a new version on our website www.bulgariaholidaytransfers.com. The customer should regularly check our website for any changes to the terms and conditions. The terms and conditions that govern the purchase of any service are the terms and conditions in effect on the date of your order. Your order must be placed online by completing all mandatory fields on the booking form on our website www.bulgariaholidaytransfers.com. In rare cases, an order may be placed by telephone or email. If your order is placed by telephone or email, the customer agrees that the booking is made on the same terms as via the website www.bulgariaholidaytransfers.com. When two or more people are included in the same booking or when the booking is made on behalf of any third parties, the person making the booking (the client) acts as agent for the other passengers and therefore agrees to all the terms and conditions of Bulgaria Holiday Transfers on their behalf. At the time of booking, the client confirms that he/she is of legal age and warrants that all information provided is correct, accurate and complete. In addition, he/she confirms that the credit or debit card used is his/hers or he/she has the right to use it and that we have his/her confirmation of the right to charge the required amount for the booked transfer services. Bulgaria Holiday Transfers is not responsible for any errors in booking, incorrect or false information and will not refund the cost of the service in the event that services are missed or delayed due to such errors. We recommend that you place your booking at least 24 hours before the transfer service. We are not responsible and will not provide transfers booked less than 24 hours before the service. In case the booking is made less than 24 hours in advance, the client must additionally contact us at the phone number indicated on our website to clarify the possibility of such a service.

Rates and payment methods

"D&K Travel" Ltd Sometimes there may be discrepancies and changes in the announced and confirmed rates, as well as in the information available on our website. The client must check the rates for the selected transfers at the booking stage. Rates for transfer services are based on the distance between the points of transfer, the number of passengers and the type of vehicle performing the transfer. Rates are indicated per vehicle, with the exception of shuttle bus transfers, where the rate is indicated per person. Rates for individual routes are available in our booking system. If the booking system does not have a rate for the route required by the client, send us your request to the e-mail indicated on our website www.bulgariaholidaytransfers.com and we will inform you of the rate for the requested route as soon as possible. Tips are not included in the rate and are at the sole discretion of the client. In our booking system you can choose one of 2 payment methods:

1. Full payment for the transfer service in advance.

2. Full payment for the transfer service is made to the driver in cash on the day of the service. Bulgaria Holiday Transfers is not responsible for losses incurred by the client when paying for the transfer services, due to currency exchange rates.

Order Confirmation

Once the customer has entered all the information in the booking form, selected the payment method and made the payment if necessary, we process the order and send him/her an order confirmation (voucher) by email, including all the transfer details. It is the customer's responsibility to check that all the information entered in the voucher is correct. If the customer finds any error or inaccuracy or if he/she has not received any confirmation by email, he/she is advised to contact us immediately. As a rule, the customer should receive a voucher including the transfer details within 24 hours of completing the booking. The order confirmation (voucher) is in all senses a travel ticket, which must be printed and presented to the driver of the vehicle that will perform the transfer before your trip. The transfer may be refused to the customer if the voucher is not presented. Order modification Orders can be modified by the client no later than 24 hours before the date of the first (or only) booked and scheduled transfer by sending a written request for modification by email to: bulgariaholidaytransfers@gmail.com. Requests will be reviewed on the day they are received. We do our best to assist the client, but we cannot guarantee that all requests and modifications will be fulfilled. Additional charges may apply. If the client does not receive a confirmation of the modification by email, he/she must contact us at the phone number listed on our website.

Order modification

Orders can be modified by the client no later than 24 hours before the date of the first (or only) booked and scheduled transfer by sending a written request for modification by email to: bulgariaholidaytransfers@gmail.com. Requests will be reviewed on the day they are received. We do our best to assist the client, but we cannot guarantee that all requests and modifications will be fulfilled. Additional charges may apply. If the customer does not receive a confirmation of the change by email, he/she should contact us at the phone number listed on our website.

Cancellation of an order

The client can cancel his/her order at any time before the date of the first (or only) booked transfer by sending a written cancellation request by e-mail to the e-mail address bulgariaholidaytransfers@gmail.com. The cancellation will be confirmed by e-mail. If the client does not receive a confirmation of the cancellation, he/she must contact us at the phone number indicated on our website.

In case of cancellation of the order by the client and full prepayment of the transfer service:

1. The cost of the transfer is refunded to the client in full if the order is cancelled more than 5 days before the scheduled date of the transfer.

2. 80% of the total cost of the transfer is refunded to the client if the order is cancelled less than 5 days before the scheduled date of the transfer.

In case the transfer service is paid by the client with a bank card, the funds will be returned via a cancellation transaction to the client's card within 14 working days from the date of receipt of the order cancellation confirmation by the client.

Bulgaria Holiday Transfers reserves the right to cancel any order at any time in case it cannot guarantee the proper performance of the service, by returning the cost of the booked service to the client in full. The refund amount will not exceed the initial costs incurred by the client when booking.

Vehicles

Bulgaria Holiday Transfers offers transfer services with the following vehicles: cars (1-3 passengers), cars (1-4 passengers), minibuses (up to 8 passengers), minibuses (up to 13 passengers), minibuses (up to 16 passengers), minibuses (up to 19 passengers), buses (up to 50 passengers).

All vehicles used by Bulgaria Holiday Transfers for transfers have proper third party liability insurance in accordance with the current legislation of the Republic of Bulgaria.

Passenger Transportation

Our drivers have the right to refuse transportation to a client at any time if, in their subjective assessment, the client is intoxicated or is behaving inappropriately. In addition, drivers have the right to force the client to leave the vehicle if, in their subjective assessment, the client is behaving inappropriately. In such cases, the paid amount of the transfer service is non-refundable.

Smoking, drinking and drinking alcohol and drugs are prohibited in Bulgaria Holiday Transfers vehicles, with the exception of water and soft drinks in bottles. In the event that the client causes any damage to our vehicle, we reserve the right to file a claim in court and demand compensation from the client.

Bulgaria Holiday Transfers recommends that all students take out extended insurance, which also includes expenses incurred due to flight delays, cancellations and rescheduling or any other factors beyond our control.

According to EU Directive 2003/20/EC:

Children under 12 years of age or shorter than 135 cm (if any of these conditions apply) must use appropriate child seats. In addition, they must be fastened with adult seat belts.

However, there is an exception for licensed vehicles that may transport children without child seats.

When providing private transfers, licensed vehicles comply with the following rules:

Children under 3 years of age may travel without a seat belt and child seat (on an adult's lap) in the rear seat of the vehicle, if a child seat is not provided. However, they are taken into account when calculating the capacity of the vehicle.

If customers choose to use their own child seat or a child seat provided, the child must be included in the total number of passengers as he/she will require a separate seat in the vehicle

Children over 3 years old are always considered as adults, occupy a separate seat and must use adult seat belts unless child seats are provided. "D&K Travel" Ltd If a customer chooses to use a child seat, for safety reasons we recommend that they use their own child seat or book a child seat for the duration of the transfer with us by completing the appropriate field in the booking form on our website. Additional charges may apply.

The following rules apply to transfers on a licensed shuttle bus:

Children under 3 years are free (provided they sit on an adult's lap and not next to them). (front seats of the vehicle)

Children over 3 years old are always considered as adults, occupy a separate seat, are included in the booking and any charges for them will be charged in full.

Liability

According to the booking conditions, the transfer services must be provided with due professionalism and care.

We will not be liable in the following situations:

- When the client suffers any loss or damage caused by reasons that could not have been foreseen at the booking stage based on the information provided by him/her.

- When the client suffers any loss or damage related to any services not specified in the agreement between Bulgaria Holiday Transfers and the client.

We will not be liable and will not pay the client any compensation if our obligations to him/her are breached due to any factors, force majeure circumstances that we could not have foreseen or avoided, even if we exercised due care and diligence. Such factors may include war, threat of war, riots, civil unrest, strikes, disasters, terrorist attacks, bad weather conditions, laws passed by any government or local authority, acts of God and any other events beyond our control.

We will use all reasonable efforts to ensure that the customer is picked up at the departure point at the time stated on the booking voucher. However, we will not be liable for any loss or expense to the customer caused by reasonable or unavoidable delays; the customer must also ensure that they have booked the transfer for the correct time. We will not be liable for any loss suffered by the customer (including, for example, a missed flight) if the customer has misjudged the time of travel.

The customer is responsible for checking that all information provided on their voucher is correct, accurate and complete, and corresponds to that provided on the date of booking. The customer must notify us of any errors or inaccuracies by email or by calling the telephone number provided on our website.

In case no contact phone details were provided at the time of booking, the client is responsible for contacting Bulgaria Holiday Transfers in a timely manner to confirm the transfer time indicated in the booking. If we are unable to contact the client to notify him/her of any changes in our schedule and/or others, and the client does not contact us, this may result in the client losing the transfer or flight and no money will be refunded to the client.

Miscellaneous

The information on the duration of the transfer on individual routes, given on our website, refers to normal conditions on that route and should not be considered as reliable information, as it depends on the weather and any other road conditions and is only indicative for the clients regarding the route.

All information that clients include in the booking form must be kept secure and accessible only to authorized persons of Bulgaria Holiday Transfers, who are directly involved in providing the booked transfer services. We use the personal data of the clients solely for the purpose of providing the services and will not disclose it to third parties.

Any claims related to the transfer service, including claims for refunds, must be sent in writing by e-mail to bulgariaholidaytransfers@gmail.com within thirty days from the date of the transfer service, for which the claim is submitted.

These terms and conditions are governed by the laws of the Republic of Bulgaria. Any dispute that may arise between the client and Bulgaria Holiday Transfers shall be subject to the exclusive jurisdiction of the Court of Burgas, to the exclusion of any other judicial authority.
